What is the new Fair Work Agency?

We had had a few questions about The Fair Work Agency (FWA) and what it is exactly, so here is the answer. 

It is a new UK government body which launched on 7 April 2026. It is designed to bridge any gaps in current departments and become the single national agency for enforcing workers’ rights, replacing the current fragmented system of multiple enforcement bodies.

The FWA will take over enforcement of:

  • National Minimum Wage

  • Agency worker protections

  • Gangmaster licensing

  • (Over time) holiday pay and other employment rights

The FWA will have stronger powers to:

  • Inspect workplaces

  • Require employers to produce documents

  • Issue civil penalties for underpayment

  • Bring proceedings on behalf of workers

  • Enforce labour market criminal offences

This creates a single, unified enforcement system so workers and employers know exactly where to go for help.
